Name, signature, date ______________________

Practice note United States: this disclosure must be a clear and conspicuous document consisting solely of the disclosure (Fair Credit Reporting Act, 15 U.S.C. § 1681b(b)(2)); before an adverse action based on the report, give a copy of the report and the summary of rights (§ 1681b(b)(3)). Many states and cities have "ban the box" laws delaying criminal history questions until after a conditional offer. EU and UK: consent is rarely a valid basis for processing in employment; use legal obligation or legitimate interest, and criminal data only where authorised by law (GDPR, art. 6 and 10; UK Data Protection Act 2018, Schedule 1). France: an employer may ask only for information directly linked to the job (Code du travail L1221-6); bulletin no. 3 of the criminal record is requested only for regulated roles.
How to use it

Step by step

  1. 1List only the checks that are necessary and lawful for the role in its country.
  2. 2Give the notice after a conditional offer, and before the checks start.
  3. 3If a negative decision may follow, share the report and hear the candidate first.
